Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) form an agreement between you and TheIToons (“TheIToons,” “we,” “us,” or “our”). They apply to theitoons.com and any related website, content, communication, or service operated by TheIToons that links to these Terms (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you also represent that you have authority to bind that organization, and “you” in these Terms refers to that organization.

3. Use of the website

You agree not to:

• violate any applicable law, regulation, or third-party right;
• attempt to gain unauthorized access to the Service, related systems, or networks;
• interfere with or disrupt the integrity or performance of the Service;
• scrape, crawl, or use automated means to access the Service except as permitted by robots.txt;
• submit content that is unlawful, infringing, defamatory, deceptive, or harmful;
• reverse-engineer, decompile, or otherwise attempt to extract source code from the Service; or
• use the Service to send spam, phishing, malware, or unsolicited messages.

We may suspend or restrict access to the Service if we reasonably believe these rules have been breached.

4. Accounts and inquiries

Some features may require you to provide accurate information (such as your name, email, company, and project details). You are responsible for keeping that information accurate and for keeping any account credentials secure. Information submitted through our contact forms is handled as described in our Privacy Policy.

5. Services and engagements

Any paid branding, design, web, or app project we perform for you is governed by a separate written agreement (such as a proposal, scope of work, or master services agreement). That agreement controls over these Terms in the event of a conflict and will describe the deliverables, timeline, fees, payment terms, ownership of work product, and any warranties.

6. Payment and fees

If a paid engagement is agreed, the fees, invoicing schedule, and payment terms will be set out in the engagement document. Late payments may accrue interest or pause work as described there. Payment-card details are processed by our payment provider; we do not store full card numbers on our systems.

7. Intellectual property

The Service, including its text, graphics, logos, icons, images, source code, and overall design, is owned by TheIToons or its licensors and protected by intellectual-property laws. You may view and share links to our public pages for personal or internal-business reference, but you may not copy, reproduce, republish, modify, or distribute our content without our prior written permission.

Ownership of work product created for a specific client (logos, design systems, code, and similar) is governed by the applicable engagement agreement.

8. Third-party services and links

The Service may link to or integrate with third-party websites, tools, or platforms (for example, analytics, payment, or communications providers). We do not control and are not responsible for their content, policies, or practices. Your use of those services is at your own risk and subject to their own terms.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, TheIToons will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Where liability cannot be excluded, our aggregate liability for any claim relating to the Service during the twelve (12) months before the claim will not exceed one hundred U.S. dollars (USD 100) or the amount you paid us for the Service during that period, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless TheIToons and its officers, employees, and contractors from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any applicable law or third-party right.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or if we are required to do so by law. You may stop using the Service at any time.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. The courts located in India will have exclusive jurisdiction over any disputes arising from or related to the Service or these Terms, except where a contrary mandatory law applies.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Service after a change indicates your acceptance of the updated Terms.
